Terms & Conditions

Last updated: 12 May 2025 · Effective date: 12 May 2025

1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

2. Acceptance of terms

By submitting an enquiry, completing enrolment, or accessing Programme Content, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.

You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are enrolling on behalf of an organisation, you represent that you have the authority to bind that organisation.

3. Programme description and availability

Garuda Tech offers part-time online programmes for practitioners who want to develop AI engineering skills. The three current programmes are described on our website at garudaaq.biz/solutions.html. Programme details, including duration, structure, and price, are stated at the time of enquiry and confirmed at enrolment.

Programmes are delivered primarily online, with recorded sessions and live small-group sessions conducted via video conferencing tools. We make no representation that our services are suitable for use in any particular jurisdiction outside Thailand.

We reserve the right to cancel or reschedule a cohort if the minimum enrolment threshold is not met. In that event, enrolled Learners will be offered a full refund or a place in the next available cohort.

4. Enrolment and access

Enrolment is confirmed when payment has been received and we have sent a written confirmation. Access to Programme Content is provided at or before the cohort start date.

Access credentials and cohort channel invitations are personal to the enrolled Learner and must not be shared with third parties. Learners are responsible for maintaining the security of any access credentials provided.

Learners who are unable to complete a Programme in the enrolled cohort may, at our discretion and subject to availability, be offered a transfer to a future cohort. This is not a standard entitlement and will be considered on a case-by-case basis.

5. Learner responsibilities

As a Learner, you agree to:

6. Intellectual property

All Programme Content, including recorded sessions, written materials, exercise specifications, and structural frameworks, is the intellectual property of Garuda Tech and its contributing instructors. We grant enrolled Learners a limited, non-exclusive, non-transferable licence to access and use Content for their personal learning during the Programme.

Work you produce as part of Programme exercises and portfolio projects remains your intellectual property. You grant Garuda Tech a non-exclusive licence to use anonymised descriptions of your portfolio work for curriculum development and marketing purposes, unless you ask us not to in writing.

7. Fees and payment

Programme fees are stated in Thai baht (THB) and are inclusive of VAT where applicable. Current fees are:

Payment is due before the cohort start date. Payment methods and invoicing arrangements are confirmed during the enrolment conversation. VAT invoices are available for corporate enrolments on request.

Refund policy: If you withdraw from a Programme more than fourteen days before the cohort start date, we will refund the full fee. If you withdraw within fourteen days of the start date, we will refund fifty percent of the fee. After the cohort has begun, we do not offer refunds except in circumstances where Garuda Tech cancels the cohort. These terms do not affect any rights you have under applicable Thai consumer protection law.

8. Course-specific terms

Garuda Tech does not issue formal certificates or qualifications. The primary outcome of our programmes is the work you produce — exercises and, for longer programmes, a portfolio project. We do not guarantee employment, career advancement, or any specific professional outcome as a result of completing a Programme.

The Architecture Programme portfolio project is self-directed within the programme's scope. We review and provide feedback on portfolio work during cohort sessions; we do not formally assess or grade it.

9. Disclaimers

Programme Content is provided for educational purposes. It reflects the knowledge and experience of the instructors at the time of delivery and is not a substitute for professional advice in specific technical, legal, financial, or other regulated domains.

We make reasonable efforts to keep Content current, but we do not represent that all tools, frameworks, or practices described will remain current, available, or suitable for any particular purpose after the cohort ends.

Content is provided "as is". We do not warrant that Content is free from errors or that access to Programme platforms will be uninterrupted.

10. Limitation of liability

To the maximum extent permitted by Thai law, Garuda Tech's total liability to any Learner arising from or in connection with a Programme — whether in contract, tort, or otherwise — is limited to the fee paid by that Learner for the Programme in question.

We are not liable for indirect, consequential, or incidental losses, including loss of income, business opportunity, or data, even if we were advised of the possibility of such losses.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Garuda Tech, its instructors, and its staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms or your misuse of Programme Content.

12. Termination

We may terminate or suspend your access to a Programme without refund if you breach these Terms in a material way and do not remedy the breach within seven days of written notice from us.

Sections 6 (intellectual property), 9 (disclaimers), 10 (limitation of liability), 11 (indemnification), and 13 (dispute resolution) survive termination of your enrolment.

13. Governing law and dispute resolution

These Terms are governed by the laws of Thailand. Any dispute arising from or in connection with these Terms or a Programme shall first be referred to informal negotiation between the parties. If a dispute is not resolved within thirty days of written notice, it shall be submitted to the jurisdiction of the courts of Bangkok, Thailand.

14. General provisions

15. Changes to these terms

We may update these Terms from time to time. The revised Terms will be published at garudaaq.biz/terms-conditions.html with an updated date. For material changes, we will notify Learners currently enrolled in an active cohort by email at least fourteen days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
